ASH NIGHT Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the ASH NIGHT service marketplace platform (“ASH NIGHT”, “we”, “us”, “our”). By accessing, browsing, or using ASH NIGHT, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not use our platform.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the ASH NIGHT platform, you acknowledge and agree to be legally bound by these Terms and our Privacy Policy.

2. User Eligibility

  • You must be at least 18 years old to use ASH NIGHT.
  • You agree to provide accurate and complete information during registration and to keep your account information up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Service Marketplace

  • ASH NIGHT is a platform that connects Service Providers with Clients (“Service Requesters”) for a variety of services.
  • All services must be transacted and paid for through the ASH NIGHT platform.
  • ASH NIGHT is not a party to any agreement between users, but facilitates secure payments and dispute resolution.
  • We do not guarantee the quality, safety, legality, or delivery of services rendered by Service Providers. Users engage with each other at their own risk.

4. Payments and Fees

  • Clients are required to pay the full service fee to ASH NIGHT at the time of placing an order.
  • Payments are securely held in escrow by ASH NIGHT until service completion and confirmation by the Client.
  • After confirmation, funds will be released to the Service Provider, minus any applicable platform fees.
  • All fees and charges are non-refundable unless expressly stated otherwise in these Terms or as required by law.
  • ASH NIGHT reserves the right to change pricing, platform fees, and payment methods at any time, with notice to users.

5. Refunds, Cancellations, and Disputes

  • Clients may request a refund or open a dispute within 24 hours of service delivery if the service is not provided as agreed.
  • Disputes must be submitted via the platform’s support or dispute form, with supporting documentation if required.
  • Refund requests or disputes submitted after 24 hours may not be considered, and funds may be released to the Service Provider.
  • ASH NIGHT will review disputes impartially and may request evidence from both parties.
  • ASH NIGHT’s decision regarding refunds and dispute resolution is final and binding.
  • No refunds will be provided after funds are released to the Service Provider, except in cases of proven fraud or violation of these Terms.

6. User Responsibilities and Code of Conduct

  • All users agree to act respectfully, honestly, and lawfully while using ASH NIGHT.
  • Service Providers must deliver services as described, on time, and with a professional standard of quality.
  • Clients must provide clear instructions and communicate promptly with Service Providers.
  • Any attempt to circumvent the platform, arrange off-platform payments, or abuse the dispute process may result in suspension or termination of your account.
  • Users are responsible for their own interactions, communications, and transactions on the platform.
  • ASH NIGHT may monitor activity and remove any content or user accounts that violate these Terms.

7. Prohibited Activities

  • Illegal, fraudulent, or abusive behavior is strictly prohibited.
  • No solicitation or arrangement of off-platform payments.
  • No posting of false information, spam, or unauthorized advertising.
  • No infringement of intellectual property or other rights.
  • Any violation may result in immediate account suspension, forfeiture of funds, and potential legal action.

8. Limitation of Liability

ASH NIGHT and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, resulting from (a) your use or inability to use the platform; (b) any conduct or content of any user; or (c) unauthorized access, use, or alteration of your transmissions or content.

Our liability to you for any claim arising out of or relating to these Terms or the platform will not exceed the total fees paid by you to ASH NIGHT in the preceding twelve (12) months.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Intellectual Property

All content, branding, and materials on ASH NIGHT, except for user-generated content, are the property of ASH NIGHT and protected by copyright and other laws. You may not use, copy, or distribute any content from ASH NIGHT without our prior written permission.

11. Termination

We reserve the right to suspend or terminate your account and access to ASH NIGHT at any time, for any reason, including violation of these Terms. Upon termination, your right to use the platform ceases immediately, and any funds held may be subject to investigation or forfeiture in accordance with these Terms.

12. Changes to Terms

ASH NIGHT reserves the right to modify or update these Terms at any time. Changes will be effective upon posting on the platform. Your continued use of ASH NIGHT after any changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which ASH NIGHT operates, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the appropriate courts of that jurisdiction.
